Kernaussagen der Rechtspädagogik
Recht ist das zentrale Element des Zusammenlebens einer von Kulturenvielfalt bestimmten Welt.
Damit das Zusammenleben funktioniert, muß das Recht Elemente enthalten, die denen des Menschen immanent sind.
Um diese Elemente zu ermitteln, bedarf es einer systematischen Rechtsgewinnung.
Die systematische Rechtsgewinnung wird im Rahmen der Zweistufentheorie des Rechts praktiziert.
Stufe 1: Verständigung auf wertneutrale, Kulturen übergreifende Ordnungsregeln.
Stufe 2: Verständigung auf Regeln des Zusammenlebens, die einen gemeinsamen, Kulturen übergreifenden (neuen) ethisch-moralischen Grundkonsens auf der Basis des kleinsten gemeinsamen Nenners enthalten.
Hauptprinzipien des friedlichen Zusammenlebens sind
Empathie /Liebe, Vernunft und Dynamik.
Im Rahmen dieser drei Hauptprinzipien sind
21 Rechtspädagogische Regeln aufgestellt (Anlage)
Die 21 rechtspädagogischen Regeln sind meist bekannt und einfach und kompatibel mit
• Grundüberzeugungen in der heutigen Philosophie
• Der Menschenrechtskonvention von 1948 und
• Demokratischen Rechtsordnungen,
• den meisten anderen Menschenrechtsordnungen,
• den meisten Religionen,
• Modernen Pädagogischen Wissenschaften (demokratischer Erziehungsstil)
• Erkenntnissen der heutigen Anthropologie, Ethnologie, Psychologie, Medizin
Wer die 21 Rechtspädagogischen Regeln kennt, kennt auch die elementaren Elemente
• Des Rechts,
• Die Pädagogik,
• der Psychologie,
• der meisten Religionen
• usw.
Diese Vereinfachung ist wichtig zur Überbrückung unterschiedlicher Bildungsstufen und unterschiedlicher Kulturen

Key messages of human law
The central element of life of a world of cultural diversity is right.
For coexistence to work, right must contain as elements, which are immanent of people.
To determine these elements, there is a systematic production of law.
The systematic production of law practised in Theory of the two levels of law
Step 1: Agreement on value-neutral cultures overarching rules.
Step 2: Right has an internationally binding ethical and moral reason guidance. Level 2: Agreement on rules of coexistence, which contain a common, cultures cross (new) ethical and moral consensus on the basis of the lowest common denominator.
Main principles of peaceful coexistence are
Empathy / love, reason and dynamic.
Within the framework of these three main principles 21 rules of Human Law are set up
The 21 rules of Human Law are usually known and simple and compatible with
• Core beliefs in modern philosophy
• The Convention of 1948 and democratic legal systems,
• The most other human law,
• The most religions,
• Modern pedagogical sciences (Democratic parenting style),
• Knowledge of current anthropology, Ethnology, psychology, medicine
Who knows the 21 rules of Human Law, knows the basic elements of the
• right
• psychology,
• the pedagogy,
• the most religions,
• etc.
This simplification is important to bridge different training and different cultures
